Terms for using Webcore services.
These terms set out the general conditions that apply to Webcore services, including acceptable use, customer responsibilities, service operation and support.

Draft for review before production publication. This version reorganises the substance of Webcore's existing published terms for the new website. Commercial, SLA, cancellation and legal provisions should be confirmed before these terms replace the currently published agreement.
1. Services and agreement
Webcore provides hosting, infrastructure, software and related technical services according to the service ordered and any additional agreement made with the customer. Service-specific orders, proposals, statements of work or licence terms may supplement these general terms. Where a specific written agreement conflicts with these general terms, the specific agreement will apply to the extent of that conflict.
2. Customer responsibilities
Customers are responsible for providing accurate account and contact information, keeping account credentials secure, and ensuring that their use of Webcore services complies with applicable law and these terms. Customers remain responsible for activity carried out through their accounts and for content and systems they place on services unless responsibility has expressly been accepted by Webcore under a managed service agreement.
3. Acceptable use
Webcore services must not be used to distribute spam, operate malicious software, conduct phishing, compromise other systems, facilitate unlawful activity, host unlawful or deliberately harmful material, impersonate others, or collect personal information unlawfully. Use that materially threatens the security, stability or availability of Webcore infrastructure or other customers may also be restricted.
4. Security and service protection
Where a service, server, website or account is compromised or presents a material risk to Webcore infrastructure, other customers or third parties, Webcore may take reasonable protective action. This can include restricting access, isolating a workload, removing identified malicious content or temporarily suspending affected services while the issue is investigated and remediated.
5. Service changes and maintenance
Webcore may carry out maintenance, upgrades and changes required to operate, secure or improve its services. Where a material planned change affects a customer's service, Webcore will provide notice where reasonably practicable. Emergency security or availability work may need to be carried out without normal notice.
6. Support
Support is provided according to the service or support agreement purchased by the customer. Existing customers should submit and manage support requests through the Webcore customer portal. Enhanced or service-specific response commitments apply only where they form part of the relevant service agreement or SLA.
7. Service availability and SLA
Where a service includes a Service Level Agreement, availability targets, exclusions, service credits and the process for making a claim are governed by that SLA. Scheduled or emergency maintenance, customer-caused incidents, third-party failures and events outside Webcore's reasonable control may be excluded as specified by the applicable SLA.
8. Billing, suspension and cancellation
Charges, billing periods and payment terms are those agreed when the service is ordered or subsequently varied by agreement. Services may be suspended for overdue payment or material breach of these terms, subject to the applicable agreement and law. Cancellation does not remove responsibility for charges already accrued or other amounts properly due under an agreed minimum term.
9. Software and licensing
Software, licences and third-party products supplied as part of a service remain subject to the applicable licence conditions. Unless expressly permitted, customers may not redistribute Webcore software or licence rights supplied for use with a specific service.
10. Backups and recovery
Backup, retention and recovery arrangements vary by service. Customers should not assume that a backup or recovery service is included unless it is identified in their service specification. Where Webcore provides managed backup or recovery, the scope and retention applicable to that service govern what can be restored.
11. Liability
Webcore's existing published terms limit liability for indirect, incidental and consequential loss and place an aggregate limit on liability. The precise limitation applicable to a customer should be confirmed against the final production terms and any service-specific agreement before this draft replaces the current terms.
12. Law and jurisdiction
The existing Webcore terms provide for Irish law and the jurisdiction of the courts of Ireland. This provision should be retained in the final agreement subject to legal review.
13. Notices and changes
Webcore may provide service or contractual notices through appropriate customer contact channels, including email, the customer portal or notices associated with the relevant service. Updated general terms may be published on this website, subject to any notice requirements contained in the applicable customer agreement.
